Negotiation

Our primary objective is always to assist our clients in avoiding lengthy and costly dispute processes and to facilitate early and amicable resolution wherever practicable. Foremost, we always urge our clients to resolve disputes amicably by means of negotiated settlement.

As part of this process we can actively manage the amicable settlement process on behalf of our clients. This involves the presentation of synopsis of the client's claim position of the opposing side and the participation in subsequent negotiation discussions.

Claim management involves the formation of a structured claim strategy and tactical advice on the measures to be implemented in order to successfully prosecute or defend claims.

Our approach is to discuss the client's specific objectives and desired outcomes and then formulate a recommended strategy to achieve them. Once a consensus is reached, the strategy is then implemented.

Contract Governance

Contract Governance and due diligence is designed to examine various elements to provide a level of surety that contractual obligations and undertakings comply with the contract, company policies and procedures as well as statutory requirements. This is designed to provide a risk mitigation control and examines elements such as financial capacity, business operations, tri-partite dependencies, etc.

Often during the transition-in period, there are many processes that need to be mapped and implemented to support the service requirements. These processes will, for example, likely include customer requests and help desk, contractor checks and site inductions, essential service and compliance testing, access and security requirements, RACI's approval delegations to name a few.

Although some of these processes may exist and may be able to be adapted, many will need to be developed, documented and implemented with agreement between the parties in contract.
